Terms of Service

The agreement behind the product.

These terms are the agreement between you and Echoryte: what the service does, what you may upload, how plans and billing work, how cancellation and refunds work, and the limits of our responsibility.

These Terms of Service form a binding agreement between you and Echoryte covering your use of the website, the application, and everything the service produces for you. If you use Echoryte on behalf of an organisation, you confirm you are authorised to accept these terms for it, and "you" means that organisation.

You must be at least 16 years old, or the minimum age of digital consent where you live if that is higher, to hold an account.

Our Privacy Policy is part of this agreement and explains how we handle your data.

Echoryte accepts audio and video you provide, produces transcripts, subtitles, translations, and AI-assisted notes and answers from them, and gives you tools to edit and export the result, subject to your plan’s limits.

Automatic speech recognition, translation, and AI output are estimates. Wording, speaker labels, timing, and summaries can be incomplete or wrong, and accuracy varies with audio quality, accent, background noise, and subject matter. You are responsible for reviewing output against the source before you rely on it, and you should not use it as the sole basis for legal, medical, financial, safety, or other consequential decisions.

We may change, add, or withdraw features as the product develops. If we discontinue something material to a paid plan, we will give reasonable notice and, where it leaves you with time you paid for and cannot use, a proportional refund.

You need an account to use anything beyond the anonymous trial. Keep your credentials confidential; you are responsible for activity under your account, and you should tell us promptly if you suspect unauthorised access.

Anonymous trial results are held for 24 hours and then deleted. Claim a trial into an account if you want to keep it.

You keep all rights in the media you upload and in the transcripts, translations, and exports the service produces from it. We claim no ownership of your content.

You grant us only the licence we need to run the service for you: to store, process, transmit, and transform your content so it can be transcribed, translated, edited, exported, and shown back to you — including passing it to the processors listed in our Privacy Policy. That licence ends when you delete the content or your account, subject to the retention periods in that policy.

We do not use your content to train our own or any third party’s models.

You must have the rights and the lawful basis to upload each recording, including any notice or consent that the people recorded are entitled to under the law that applies to them.

You may not use Echoryte to upload or produce material that is unlawful, infringing, defamatory, or that you have no right to process; to record or transcribe people in breach of wiretapping, privacy, or consent laws; to harass, deceive, or harm anyone; or to generate content that facilitates illegal activity.

You may not attempt to break, overload, reverse engineer, or circumvent the service or its limits — including probing security controls, evading quotas or rate limits, scraping the service, or reselling access without our agreement.

If you breach this section we may suspend or terminate your account. Except where a serious or illegal breach requires immediate action, we will tell you why and give you a chance to respond. If we terminate for a breach you did not commit, we refund the unused portion of your term.

Verified Free accounts receive 400 one-time credits, with no daily refill. Credits are shared across paid transcription, AI and translation calls. Per-file length and size limits still apply.

Pro and Business include credits for each paid billing period. Annual credits are issued once for the year. Subscription credits expire at the end of their period; unused credits do not roll over. Insufficient credits stop new paid calls; there are no automatic overage charges.

Providers occasionally fail or fall behind. We aim for a reliable service but do not offer a specific uptime guarantee on these plans.

Payments are processed by Stripe. Stripe shows the exact amount, currency, and any applicable tax before you confirm, and that confirmation screen — not the price displayed elsewhere on the site — is the amount you agree to pay.

Subscriptions renew automatically at the end of each billing interval at the then-current price, until you cancel. If we change the price of a plan you are on, we will tell you before the change applies to your renewal, and you can cancel before it takes effect.

Prices are exclusive of tax unless stated otherwise; Stripe calculates and adds any tax due for your location. You are responsible for keeping your billing details current.

If a payment fails, we may retry it and may suspend Pro features until it clears. Your files are not deleted because of a failed payment — the account simply returns to Free-plan limits.

You can cancel at any time from your billing page, which opens the Stripe customer portal. Cancelling stops the next renewal; it does not end the period you have already paid for. Pro features stay available until that period ends, and the account then moves to the Free plan.

Cancelling is not the same as a refund, and cancelling does not by itself return money for the current period.

If Echoryte does not work as described, tell us within 14 days of the charge at support@echoryte.com with your account email and what went wrong. Where the problem is on our side — the service was unavailable, jobs failed persistently, or you were charged in error or after cancelling — we refund the affected period in full.

Outside those cases, refunds are discretionary and we will normally decline where the plan was substantially used during the period, since usage is not reversible. We do not refund partial periods after a voluntary cancellation.

Where consumer law gives you a statutory right of withdrawal — for example the 14-day cooling-off period in the EU and UK — that right applies regardless of anything in this section. Note that by starting to use the service immediately you may consent to us beginning performance during the cooling-off period, which can reduce a withdrawal refund proportionally to what you used.

Approved refunds go back through Stripe to the original payment method. How quickly the money appears is controlled by your bank or card issuer, not by us; it is typically 5–10 business days. Taxes are refunded in line with the original charge.

You can delete your account at any time from account settings. Deletion starts the removal process described in our Privacy Policy, and it does not entitle you to a refund beyond the section above.

We may suspend or terminate an account for a material breach of these terms, for non-payment, or where we are legally required to. Before deleting anything, export what you need.

We may also stop offering the service entirely. If that happens we will give reasonable advance notice, keep exports available during that notice period, and refund the unused portion of any prepaid term.

The Echoryte name, site, software, and design are ours or our licensors’, and nothing in these terms transfers them to you. You may use the service, but not copy, resell, or build a competing product from it.

If you send us feedback or suggestions, we may use them to improve the product without owing you anything for them.

The service is provided as it is and as available. To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that output will be accurate or that the service will be uninterrupted or error-free.

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, or consequential loss, or for lost profits, revenue, goodwill, or data, arising out of these terms. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or USD 100 if you paid nothing.

Nothing here excludes liability that cannot be excluded by law — including liability for death or personal injury caused by negligence, for fraud, or under the mandatory consumer rights that apply where you live. If you are a consumer, those rights sit alongside these terms and are not reduced by them.

You agree to cover us against third-party claims arising from content you uploaded without the rights or consents required, or from your use of the service in breach of these terms, to the extent the law permits.

We may update these terms as the service or the law changes. The date at the top reflects the current version, and material changes are announced by email or in the app before they take effect. If you keep using Echoryte after that date, the updated terms apply; if you do not accept them, cancel before the date and we will refund any unused prepaid period.

If any provision is held unenforceable, the rest stays in force. Our not enforcing a right immediately does not waive it. You may not transfer this agreement without our consent; we may transfer it to a successor in a merger or acquisition.

Before starting formal proceedings, please write to support@echoryte.com — most problems are faster to resolve directly. If you are a consumer, you keep the right to bring proceedings in the courts of your country of residence and to rely on its mandatory consumer law.
